The stages required to achieve success include:
Step 1
Initial development appraisals and valuations to weigh up the viability of seeking change of use.
Step 2
Seeking the best route to maximising land value through one of the methods of promotion mentioned above. If promoting via an Option or Land Promotion Agreement we ensure all the costs are paid for by the chosen development partner and not the landowner.
Step 3
Identifying the best companies whether a housebuilder or promoter to deliver the planning permission assuring the legal agreement is sound and meets the needs of the landowner(s). If multiple landowners are involved then a Landowners Agreement will also be required to ensure they all agree to co-operate.
Step 4
Once a development partner is appointed we monitor their progress and ensure key planning stages are achieved in timely fashion through to grant of planning permission.
Step 5
Once the Local Planning Authority has resolved to grant planning permission, the permission is not issued until the S106 planning agreement with the Local Planning Authority is completed so we assist the promoter and planning consultants with this document.
Step 6
On grant of planning permission recommend the best method of selling in the open market and also timing. On sale it important that there is an accurate reconciliation of all the costs and sharing of sale proceeds between the parties involved.
The Planning System is complicated and it is important there is a working knowledge of it. The main policy documents include:
• The National Planning Policy Framework
• From this policy document the Local Planning Authority prepares and adopts a Local Plan.
• Some villages and towns may also have a Local Neighbourhood Plan.
Tax
It is also important owners consider the tax implications of property development and whether the asset is privately owned, in a company or a Trust. Capital Gains Tax and roll over relief, Corporation Tax and VAT are all considerations.
